Background: The role of nurses as patient advocates is one which is well recognised, supported and the subject of a broad body of literature. One of the key impediments to the role of the nurse as patient advocate is the lack of support and legislative frameworks. Within a broad range of activities constituting advocacy, whistleblowing is currently the subject of much discussion in the light of the Mid Staffordshire inquiry in the United Kingdom (UK) and other instances of patient mistreatment. (...) As a result steps to amend existing whistleblowing legislation where it exists or introduce it where it does not are underway. Objective: This paper traces the development of legislation for advocacy. Conclusion: The authors argue that while any legislation supporting advocacy is welcome, legislation on its own will not encourage or enable nurses to whistleblow. (shrink)

We respond to Autumn Fiester’s critique that our proposed bioethical consensus project amounts to “ethical hegemony,” and evaluate her claim that ethicists should restrict themselves to “mere process” recommendations. We argue that content recommendations are an inescapable aspect of clinical ethics consultation, and our primary concern is that, without standardization of bioethical consensus, our field will vacillate among appeals to the disparate claims in the 22 “Core References,” unsustainable efforts to defend value-neutral process recommendations, or become a practice of Lone (...) Ranger clinical ethicists. We contend that a consensus document that captures the basic moral commitments of patients and careproviders is the next step in the professional evolution of our field. We argue that the American Society for Bioethics and Humanities has endorsed a facilitation approach to clinical ethics consultation that asserts that bioethicists can offer moral recommendations that are well-grounded in bioethical consensus. We claim that the closest thing the field currently has to a citable, nationally endorsed bioethical consensus are the 22 Core References used to construct the questions for the Healthcare Ethics Consultant-Certified (HEC-C) exam. We acknowledge that the Core References reflect some important points of bioethical consensus, but (...) note they are unwieldy, repetitive, and sometimes inconsistent on important issues faced by clinical ethicists. In this article, we draw carefully qualified inspiration from the Ethical and Religious Directives for Catholic Health Care Services (ERDs) to argue for the creation of a concise, nationally endorsed bioethical consensus document on moral issues commonly faced in clinical ethics, what we call the Standardized Ethical Guidelines for Secular Health Care Services (SEGs). We observe that such a document would better meet the expectations of stakeholders, clinical ethicists, and their trainees who desire moral recommendations grounded in a clearly articulated bioethical consensus, and we defend the SEGs from some common objections. Light effects on the activity of several genes have recently been exploited in studies of plant gene expression. We discuss here some examples involving nuclear genes of higher plants, with emphasis on responses mediated by the phytochrome system. Recent work has revealed considerable diversity in the responses of different genes, indicating that several different regulatory programs are probably involved. A start has been made in studies of nuclear events associated with the changes in expression. Transcriptional regulation almost certainly occurs, although (...) many details remain to be studied and effects on mRNA processing and turnover have not been ruled out. Recent in vitro mutagenesis and gene transfer experiments with the gene for the small subunit of RuBP carboxylase indicate that sequences involved in regulating the level of expression in the light are located 5′ to the gene within about 1 kb of the start of transcription. This note revisits the issue of Scipio Aemilianus’ famous prosecution of L. Aurelius Cotta, cos. 144, and argues for a reconstruction and dating that is consistent with both Per. Oxy. 55 and the references in Cicero. The appendix suggests that scholars have misunderstood Appian BC 1.22 and Cicero Font. 38 and that Appian (and perhaps Cicero) refer to another trial, namely that of L. Aurelius Cotta, cos. 119.

The boundaries of psychology have never been very distinctly defined and, as a consequence, science has witnessed frequent border incidents. But it obviously is not psychology alone which suffers from such lack of delineation, but its neighbors, the biological and social sciences, do as well. Cooperation between sciences becomes difficult under these conditions. All agree that psychology is the science of mind, but few agree to what “mind” is. At least within our century “mind” has been taken to be “behavior”, (...) for the present day outlook is that mind is behavior rather than that which is responsible for behavior. The metaphysical dynamism of a prime mover has been replaced by an experimental concept, i.e., one that is susceptible to scientific investigation. There is no need to review the complex history of behavioristic psychology in its many ramifications, ranging from Watson's mechanism to the various vitalistic teleologies. Inadequate attempts to solve these problems were crucial reasons for the breakdown of Cartesian metaphysics in the late seventeenth and early eighteenth centuries. The major difficulties derived from the acceptance of a dualism of substances seated in a system which included epistemological (...) and causal likeness principles plus an ontological framework in which the categories of substance and modification were exhaustive. The major solutions involved either denying the likeness principles or altering the ontological framework. The first led to unintelligibility ; the second, culminating in Hume, opened the way to non-Cartesian metaphysics. The first section of this study contains a characterization of late seventeenth -century Cartesian metaphysics. The second is an exposition of Foucher 's four major criticisms of this system. In the third section, monistic solutions suggested in Descartes and by Spinoza, Foucher, Leibniz, and Locke are considered; in the fourth, the dualistic solutions of the orthodox Cartesians Rohault, R~gis, Desgabets, La Forge, Le Grand, and Arnauld; and in the fifth, the occasionalist solution of Malebranche. The sixth section is an analysis of these orthodox and occasionalist solutions, showing how each ultimately fails because of dependence upon the ontology of substance and modification. The seventh section is a consideration of Berkeley and Hume in the Cartesian context. A consideration of their systems as offering solutions to Cartesian problems illuminates in new light both the systems and the problems. In broad terms, this study moves from a consideration of problems arising from an ontology of two substances, to a consideration of problems arising from the ontological pattern of substance and modification. The Cartesians were concerned with relationships between two substances, but they saw no difficulties connected with the relationship between a substance and its modifications (or properties). Berkeley's treatment (deriving from Male- [177] 178 HISTORY OF PHILOSOPHY branche) of the relationships between mind and idea, and between mind and notion, is illuminated by a consideration of the extent to which he took these relationships for granted in the Cartesian way, and of the extent to which he saw difficulties in the relationship between substance and modification. The Berkeleian solution to Cartesian problems, like that of Malebranche before him, was not successful; Malebranche belittled, and Berkeley denied the dualism of substances, but neither philosopher could break entirely with the ontological pattern of substance and modification. The final breakdown of Cartesian metaphysics came with Hume, who, in providing the culmination of a most important trend in modern philosophy, opened the way to new metaphysics and became the father of contemporary philosophy. Douglas Olson have collaborated to produce a generous work of scholarship that offers (...) a comprehensive perspective on this Aristophanic comedy, which playfully imagines the tragedian Euripides and his kinsman-by-marriage (the "Inlaw") fighting for their lives as they seek to allay the wrath of the matrons of Athens, who have been angered by Euripides' representations of female characters, during an annual women's festival (the Thesmophoria) honoring Demeter and Persephone. The volume offers a new and carefully edited text, which incorporates emendations that Austin has already proposed in separately published articles, and an informative apparatus criticus. On every page of the text there is a second apparatus (standard in Oxford University Press's recently published editions of Aristophanes) that indicates where words and verses are cited in the works of later authors (e.g., Philostratus, Lucian) and [End Page 140] in ancient and medieval lexica (e.g., Hesychius, the Suda). The introduction and meticulously detailed commentary supply extensive information about the comedy, the circumstances of its original production in 411 b.c.e., its relationship to other Aristophanic dramas, the history of its transmission, and a host of related topics. A bibliography, two indices (one for Greek words and one for general references), and two color plates of the Würzburg krater, representing the comedy's parody of Euripides' Telephus, complete the volume. Students and scholars with a variety of interests and needs will find this edition of Thesmophoriazusae most useful. Thanks to its editors' erudition and the thoughtfulness of their presentation, it is also a pleasure to read.In the introduction's summary of Thesmophoriazusae's manuscript tradition (lxxxix-xcviii), the survey of the most frequent errors in Ravennas 429 ("R," the tenth-century manuscript that is the only independent witness for its complete text) permits readers to get a sense of the kinds of emendations that have become common property in most of the editions published since the Renaissance. These conventional emendations aside, Thesmophoriazusae's text still leaves much room for editorial discretion, which Austin and Olson always exercise judiciously (even if one disagrees on occasion with their choices). Most importantly, a keen appreciation of Aristophanes' humor consistently informs their decisions concerning emendation, as is revealed by the interpretations of the jokes in 12 (defending the verse against deletion), 232 (retaining R's α), 242 (retaining R's and accepting Medaglia's restoration of ), 912 (retaining R's ), and 1094 (accepting Brunck's supplement ). They are also guided by the concern for making the text square with fifth-century Attic usage: see, e.g., the restoration of (for ) to 758-59 and the preferences for (over the transmitted v) in 173 and 478 and for (over the transmitted ) in 554.An unusual textual feature in this comedy—and an editorial challenge—is the pidgin-Greek spoken by the Scythian archer who guards the captured Inlaw in 1001-1225. Austin and Olson print his part without accents because, as they explain in the commentary's note on these verses (which also supplies a helpful list of the idiosyncrasies in his speech), "he must consistently have got [the accents] wrong" (308). Other editorial decisions (e.g., Austin's for R's unmetrical in 1088) bear out the editors' perception of the Scythian as a consistently bad speaker of Greek (325, n. on 1087-89).The comedy's lyric passages arguably present its thorniest set of editorial challenges. Most of the songs are marked by complexities in their rhythmic patterns; there is relatively little strophic responsion, and the two showcased parodies of tragic lyric (Agathon's song in 101-29 and the Inlaw's reworking of Andromeda's lament in 1015-55) feature elaborate polymetry that additionally complicates the tasks of interpreting and editing. Phillips published an article describing what he observed to be the inverse relationship between inflation and unemployment; subsequently, the "Phillips curve" became a central concept in macroeconomic analysis and policymaking. But today's Phillips curve is not the same as the original one from fifty years ago; the economy, our understanding of price setting behavior, the determinants of inflation, and the role of monetary policy have evolved significantly since then. One dark and rainy night, Yuso sexually assaults and tortures Zelan. In escaping from the scene of his crime, he falls heavily and becomes an impotent paraplegic. Instead of treating his fate as divine retribution for his wicked acts, Yuso sees it as sheer bad luck. He shows no remorse for what he has done, and vainly hopes that he will recover his powers, which he now treats as involuntarily hoarded resources to be used on less rainy days. In the (...) presence of others, he pretends that he has turned over a new leaf. He asks for religious and educational books, hoping to make up for his poor education and deprived social background. But he immediately discards them when he is alone in favor of the pornographic magazines which he has bribed a nurse to smuggle in for him. His deception and various obscene acts committed in the hospital are exposed; by the time he comes up for trial, everyone knows that he is still a lustful, sadistic, and unrepentant man. Most retributivists have a sufficient justification for punishing Yuso independently of the social consequences of his punishment. Two features of the case might cause some difficulties. First, Yuso has already experienced considerable suffering and deprivation both before and after his crime, and retributivists might disagree about the relevance of the suffering to his punishment. Secondly, Yuso is unrepentant, and it is unlikely that punishment will change him. This might, as we shall see, create a problem for those who think that the justifying aim of punishment is the moral reform of the offender. (shrink)

In Defense of Utilitarianism, C.L. Sheng provides a more intensive study of the Unified Utilitarian Theory , which he proposed in his previous work A New Approach to Utilitarianism . Sheng defends utilitarianism, particularly UUT, against the objections and attacks raised by nonutilitarians, showing it to be a viable ethical theory.

Speech categories are defined by multiple acoustic dimensions and their boundaries are generally fuzzy and ambiguous in part because listeners often give differential weighting to these cue dimensions during phonetic categorization. This study explored how a listener's perception of a speaker's socio-indexical and personality characteristics influences the listener's perceptual cue weighting. In a matched-guise study, three groups of listeners classified a series of gender-neutral /b/-/p/ continua that vary in VOT and F0 at the onset of the following vowel. Listeners were (...) assigned to one of three prompt conditions and rated the talker in terms of vocal gender prototypicality, attractiveness, friendliness, confidence, trustworthiness, and gayness. Male listeners and listeners who saw a male face showed less reliance on VOT compared to listeners in the other conditions. Listeners' visual evaluation of the talker also affected their weighting of VOT and onset F0 cues, although the effects of facial impressions differ depending on the gender of the listener. The results demonstrate that individual differences in perceptual cue weighting are modulated by the listener's gender and his/her subjective evaluation of the talker. These findings lend support for exemplar-based models of speech perception and production where socio-indexical features are encoded as a part of the episodic traces in the listeners' mental lexicon. This study also shed light on the relationship between individual variation in cue weighting and community-level sound change by demonstrating that VOT and onset F0 co-variation in North American English has acquired a certain degree of socio-indexical significance. The purpose of this essay is to study the problem of inherent obscurity of the criterion for maximal utility in utilitarianism. For the sake of convenience of analysis, situations of moral actions are classified into four categories. It is shown that morality is flexible, especially in the positive sense, in that a virtuous action can be taken in various ways and/or to various degrees. For some situations it is inherently unclear what the moral requirement is, and whether it is a (...) maximum or a minimum. It is concluded that the schism of the principle of utility between the principle of the good and the principle of the right seems to be inevitable, and the interpretation of the ultimate criterion for maximal utility should be relaxed or interpreted separately and differently according to the situation of action. This paper discusses the nature of liberty from the point of view of value. Liberty is the highest value for liberals. The root of this liberal view is their particular conception of self. Rawls says 'the self is prior to the ends which are affirmed by it.' This is also the Kantian view of the self: the self is prior to its socially given roles and relationships. Therefore, no end is exempt from possible revision by the self. There is nothing (...) wrong with this basic idea. In fact, all theories agree on free choice of life plan or self-determination. But they disagree about what package of rights and resources best enables people to pursue their own conceptions of the good. However, the liberal view of liberty is based on a metaphysically reasoned idealism. This results in a conception of liberty that is absolute, supreme, and has infinite value compared with other things. Communitarians have several arguments against the liberal view. I consider the following two points to be of utmost import: The liberal view of the self is empty; The liberal view ignores our embeddedness in communal practices. My reasoning is not exactly that of the communitarians. I view 'emptiness' as freedom associated with the substance of an action, which has a value that does not lie in itself. (shrink)

“Career value” is the name of a kind of value I used (or perhaps I coined) in my classification of value according to good things in life based on the law of nonreplaceability. I classify value into seven classes: (1) health value, (2) sentimental value, (3) economic value1, (4) belief value, (5) environmental value, (6) social value, and (7) career value. Career value refers to the extra value of the most important work, which one wants to do and actually does (...) in one’s life time, for oneself. In Section 2, I explain the nature of career value, which is different from the natures of all other values. In Section 3, I discuss various career values themselves. Career value has several different forms, depending on the nature and size of career. Finally, I conclude that, except for economic value3, which isunsuitable and unreasonable to be a career value, the pursuit of any kind of a nonmaterial career value is a good thing and conforms to the maximization of social utility in utilitarianism.
